Your Duties

Under the Road Traffic Accident Protocol, the burden is on you to prove that your accident was caused because of the other driver’s actions or negligence.  It is therefore important that you provide Crest Solicitors with as much information as possible to support your accident and injuries.  Please provide to us the following where relevant:

  • Full details of the driver at fault and his/her vehicle registration.
  • Photographs/videos of the vehicles including the positioning of the vehicles post-accident.
  • Any dash cam footage of the incident.
  • Photographs of any injuries sustained, if visible.
  • The police reference number following any police attendance at the scene.
  • Details of any witnesses so that we can write to them to provide Witness Statements;
  • A description of the driver at fault and whether there were any passengers in their vehicle or provide us with any photographs obtained of them;
  • Details of the accident location.  Try to do a ‘Google’ map search to be able to demonstrate exactly where the incident happened.
  • Visit your GP as soon as possible or Hospital, where appropriate. We will then obtain your medical records where relevant to support your claim for Personal Injury.
  • Provide a copy of any details exchanged at the scene i.e. if it was written down on a piece of paper etc

Motor Insurance Bureau (MIB)

You may be in a position where you are hit by a vehicle, but the other driver drives off from the scene, or you are provided with the other drivers’ details but later discover that they are uninsured. In those circumstances, you can still pursue a claim for Personal Injury.

The MIB is a government-funded body which offers compensation to such types of claims.  Again, you are to obtain as much detail as possible, including a full description of the other driver, and to notify the police of the incident as soon as is convenient.
